Michigan law requires every seller of a one to four family residential dwelling to meet the requirements of the Sellers Disclosure Act. This law applies whether the owner uses a real estate agent in the sale or not. The disclosure must be provided prior to the seller accepting the purchasers offer. There are very few exceptions.

Federal law requires every seller (or landlord) of residential dwellings that were built prior to 1978 to provide the buyer with Lead Based Paint disclosure. There are only a few exceptions to this law. Purchasers and tenants must also be provided with a booklet entitled “Protecting Your Family From Lead In Your Home”. Purchasers (not tenants) are allowed 10 days to do an assessment of their own prior to being bound to a purchase agreement.


Real estate agents in Michigan must provide every consumer with Agency Disclosure in the following manner:
1. the agent must explain all types of agency relationships available
2. the agent must explain the licensees duties that each agency relationship creates
3. the disclosure must be in writing
4. the consumer must receive a copy of the disclosure statement
5. the disclosure must be done prior to the disclosure by the potential consumer to the licensee any confidential information
